By accessing or using ichworks' services, including purchasing products, using custom services, or interacting with our website, you agree to be bound by these Terms of Service. Please read them carefully before engaging with our platform.
1. Eligibility
You must be at least 18 years old to place an order with ichworks. By using our services, you confirm that you have the legal capacity to enter into a binding contract and that all information provided (including contact details, payment information, and customization materials) is accurate and truthful.
2. Product Information and Availability
- All product descriptions, including details about intangible cultural heritage (ICH) craftsmanship, materials, and estimated delivery times, are provided for informational purposes. While we strive for accuracy, slight variations in color, texture, or design may occur due to the handmade nature of ICH products. These variations are not defects but part of the uniqueness of artisanal craftsmanship.
- “Hands of Heritage” Collection items are subject to limited availability. Custom products are crafted on demand but may be unavailable if materials or artisans are temporarily unavailable. We reserve the right to cancel orders for out-of-stock items and will issue a full refund in such cases.
3. Orders and Payment
- Placing an order constitutes an offer to purchase. We reserve the right to accept or reject orders (e.g., for invalid information, suspected fraud, or unavailable products). An order is confirmed only when we send a confirmation email.
- Full payment is required at the time of ordering, including for custom products. We accept major credit cards and other payment methods specified on our website. Payment information is processed securely through Shopify’s payment system; ichworks does not store your payment details.
4. Custom Products
- Customization Materials: When using the “Upload My Photo” service, you confirm that you own the rights to any uploaded materials (photos, text, videos) or have obtained necessary permissions. You agree not to upload content that is illegal, infringing, offensive, or violates third-party rights. ichworks reserves the right to reject materials that violate these terms.
- Preview and Confirmation: Custom product previews are approximate and may differ slightly from the final handcrafted item. For complex ICH techniques (e.g., Suzhou embroidery, wax sculpting), our team will share a final design confirmation with you before production. By approving the design, you acknowledge that minor artistic adjustments may be made to ensure compatibility with traditional craftsmanship.
- Production and Changes: Once production of a custom item begins (after design approval), changes to the order (e.g., materials, design) may not be possible. If changes are feasible, additional fees may apply.
5. Delivery and Shipping
- Estimated delivery times for in-stock items are specified on product pages. For custom products, timelines are provided during checkout but are approximate; ICH craftsmanship requires time, and delays may occur due to artisan schedules or material sourcing.
- Shipping costs are calculated based on product weight, destination, and shipping method. We use trusted carriers and provide tracking information once items are shipped. Risk of loss or damage transfers to you upon delivery.
- International orders may be subject to import duties, taxes, or fees, which are your responsibility. We are not liable for delays due to customs processing.
6. Returns and Refunds
- In-Stock Items: You may return unused, undamaged “Hands of Heritage” Collection items within 14 days of delivery for a full refund (excluding shipping costs). Items must be returned in their original packaging.
- Custom Products: Due to their personalized nature, custom items are non-refundable unless they arrive damaged or defective. To qualify for a refund, notify us within 7 days of delivery with photos of the issue. We will either issue a refund or arrange for a replacement (if feasible).
- Cancellations: You may cancel an order for in-stock items before shipment for a full refund. For custom items, cancellations are allowed only before design approval; after approval, refunds are not guaranteed unless production has not yet started (in which case a partial refund may apply, deducting costs for materials or design work).
- Refunds are processed to the original payment method within 5–10 business days of receiving returned items or confirming a cancellation.
7. Intellectual Property
- All content on ichworks’ website (product photos, descriptions, logos, and ICH craftsmanship details) is the property of ichworks or our partners and is protected by copyright laws. You may not reproduce, distribute, or use this content without written permission.
- Custom products created using your materials remain your property, but ichworks retains the right to use photos of the final product (without identifying information) for marketing purposes, unless you request otherwise in writing.
8. Limitation of Liability
- ichworks is not liable for indirect, incidental, or consequential damages (e.g., loss of use, loss of profits) arising from product use, delays, or defects. Our total liability for any claim is limited to the purchase price of the product.
- We do not guarantee that custom products will exactly match digital previews, as handmade ICH techniques involve artistic interpretation.
9. Changes to Terms
We may update these Terms of Service from time to time. Changes will be posted on our website, and your continued use of our services after the effective date constitutes acceptance of the revised terms.
